- Standard Terms and Conditions
- The following terms and conditions outline the expectations in relation to the various services provided by The Gurney Guys. Please take the time to review and let us know if you have any questions or concerns about any information contained in this agreement as you will be deemed to be in understanding and acceptance thereof by accepting the quote either in full or part and by consenting to commencement of any relevant work.
- Description of Binding Agreement:
- These terms and conditions serve as a binding agreement between the property owner or manager or person acting on either of the aforementioned’s behalf, hereby identified as “client” or “you” and The Gurney Guys, it’s owners and Operators ( employees, and subcontractors), hereby identified as “The Gurney Guys” or “company” or “we” or “us” for the execution of services in exchange for payment for residential or commercial cleaning services. The services that we provide to the client are subject to the following terms and conditions and we reserve the right to update the terms and conditions at any time without notice to the client. The client can review the Terms and Conditions by clicking on the Terms and conditions links via our website, email communications, or any other communications such as quotes or invoice links.
- Authorizations
- The client agrees to allow The Gurney Guys access to the property for the purposes of completing the cleaning service requested. The client also agrees to allow The Gurney Guys to utilise their on-site water supply and electricity supply, unless arranged otherwise.
- Acknowledgment of Risks and Releases of Liability
- The Gurney Guys are well trained and skilled in the use of high pressure, softwashing and other related industry equipment, chemicals, processes and techniques to enable the best possible cleaning of surfaces. We will take the utmost precautions in making sure we do not cause harm to the clients' property. We use safe techniques, low pressure and carefully selected chemicals on more delicate surfaces, however, damage can still occur to any delicate surface due to poor maintenance, neglect to the property, inferior building materials or methods and /or surfaces where damage is existing and /or deterioration has started taking place. All surfaces are cleaned at the customer’s own risk and must be able to withstand normal cleaning processes. It is the client's responsibility to ensure that their property has been maintained in good condition and that any defects or areas of concern are repaired prior to washing to ensure it can withstand reasonable cleaning efforts and a watertight seal. The client assumes all risk and takes responsibility for any damage that occurs due to improper or lack of maintenance.
- The Gurney Guys are not responsible for damages due to improperly installed siding, loose, dislodged, cracked or broken roof tiles or siding, broken or opened windows, improperly sealed windows and doors, wood rot, defective construction, improperly secured wires, loose or improperly installed gutters, and leaders and improper caulking. On most of the surfaces, the sun and weather will bleach the colour, cause fading, oxidation, chalking, flaking, dislodgement of loose mortar and the like. Pressure washing, which entails the removal of chalky, gritty, or failing surface materials may cause these deteriorated aspects to stand out. The Gurney Guys will not be responsible for such conditions. On the date of service, we will walk around, inspect the property and make you aware of any pre-existing damage, deterioration or potentially risky conditions where it is reasonably visible and /or detectable.
- This assessment is not all encompassing, as additional /new damage may become apparent while the surfaces are being cleaned. If any such additional /new damage is found, we will cease all cleaning efforts until the client has been advised thereof and acknowledge its existence. Please also see subsections under which the various types of work are addressed to see related information on risks and liability.
- Booking, Cancellation & Rescheduling
- Our company’s productivity rely upon favourable weather and a variety of other factors. Inclement weather and other unforeseen situations may affect scheduling. We try our best to keep scheduling conflicts to a minimum, however, circumstances that are beyond our control may affect your project start and completion dates. You will be notified as early as possible of any changes and the company will do its best to reschedule quickly but may have to work around other scheduled clients, weather and practical matters.
- We reserve the right to alter or move a booking in line with staffing levels, weather conditions and /or machinery or equipment failure.
- The client may reschedule or cancel any appointment up to 24 hours before the scheduled commencement date of the work. Cancellations within the 24 hour period prior to commencement, may incur a $75 charge to offset costs incurred.
- In a select number of circumstances we reserve the right to request a deposit and may request an amount of up to 50% of the total quoted price for the purpose of securing or rescheduling a booking ie. during peak times in March, April and December, to cover the cost of materials, when nobody is available to make payment on completion, when the payment is to be made by a third party, when the property in question is owned by a third party or when the service is requested by vacating tenants.
- Appointment Time
- Due to traffic or unexpected circumstances, we may at times arrive late. Please allow a 30-90 minute arrival window. The company will do its best to let you know about any delays that might affect the scheduled arrival time.
- On the Day of Service
- The client shall:
- Be required to be home (or at least) at the beginning and end of our work in order to welcome the team and make final approval on the service done and payment.
- Please not book other trades on the same day as it will likely disrupt the performance of both.
- Have made the areas to be worked on the property accessible and water & electricity available & accessible.
- Closed all windows and doors tightly for Housewashing, roof Cleaning & Window Cleaning.
- Turn off all outside electrical outlets and fixtures prior to the company Operator’s arrival.
- inform the operator about any area that needs special care or should be avoided, especially for issues related to water seepage or leakage, electrical risk and or sensitive areas that can be damaged.
- Keep all pets and children inside before and during cleaning (Client to advise us of any pets that cannot be kept inside ie fish, birds etc).
- Removed all Pet food & water bowls for safekeeping indoors.
- Clear all work areas of all items and obstacles such as such as flags, doormats, plants, building materials and vehicles prior to our arrival.
- Clear the area of all plants, clothing on lines, furniture and other items as best possible prior to our arrival on day of cleaning to avoid contact from overspray.
- If the company needs to relocate items, we will not be responsible for any damage, breakage or for storage issues. An additional charge may also be applied for the time and labour devoted to the relocation of any items.
- Avoid using water during service to ensure no loss of pressure or volume.
- Advise beforehand if special arrangements are to be made in relation to any of the above.
- Product Warranties
- All warranties are limited to those offered by the manufacturers of the products used. The Gurney Guys make no additional warranties. If you ever have a concern regarding the products used or our work, The Gurney Guys should be notified immediately.
- Water Usage
- The client agrees to provide The Gurney Guys the right to use an on-site water supply as needed to complete the stated project without compensation. If an exterior water supply is required, it will be at an additional charge. It is the customer’s responsibility to make sure the water supply is on and in working order before we arrive. Additional charges will be applied if water is not available. If on well /tank water, or if in an area with low water pressure or volume, the client agrees to inform the company and will avoid or limit using water during the cleaning service.
- Electrical Usage
- The client agrees to provide The Gurney Guys the right to use an on-site source of electricity as needed to complete the services without compensation. If an exterior source is required it will be at an additional charge.
- Pressure Cleaning
- The client understands that Pressure Cleaning is a cleaning service and we cannot hold any responsibility if stains are not removed after the pressure service. Some stains cannot be removed by pressure cleaning alone. Tree sap, lichen spores, rust stains, efflorescence, many oil & grease stains, tyre marks splatters from stains and paints are examples of stains that cannot be removed by conventional means. However, our operator will try their best to identify and point out any such stains prior to starting and to remove as much of these stains as reasonably practical with conventional means. The use of very specific chemicals may be required along with hotwash machines and very specific processes to attempt to have such stains removed and will be at an additional cost. The operator will be able to advise thereon, whilst on site. Please note however that at times these stains cannot be removed at all.
- The client also understands that we are not responsible for previously existing loose and/or chip tiles and damaged grout, and also for remaining debris after cleaning due to improper drainage.
- House Washing / Soft Washing
- The client understands that any blemish or flaw or any existing oxidation will be more noticeable after cleaning. The client understands that company may not find every flaw and is not responsible if it is more noticeable after softwashing unless it is found to be as a result of negligence on the company end. The client understands that we recommend that all outside electrical outlets and fixtures are shut off before arrival to complete washing service as an additional precaution. The client also understands if we do a site unseen quote based on provided photos, that we will not be able to note any flaws in exterior surfaces. If we do a site unseen quote, the client understands that our technicians will do their best to point this out at the date of cleaning. The client also understands that our cleaning solution is specifically designed for our cleaning services and it will not cause any discoloration or damage. The client understands that during the house washing service they will receive a basic window cleaning. This is not a window cleaning service. A basic window cleaning will get debris off from the windows, but you could be left with water spots. If you are looking for a squeaky-clean shine on windows, you will want to get the added window cleaning service. The client understands that the company is not responsible for water intrusion. While every effort is made to prevent this from happening, bad seals around windows/doors and cracks in concrete foundations and defective sealing on roofs can make this unavoidable. The company assumes the structures on your property to be in good repair and watertight. This includes, but is not limited to all electrical services including power outlets, receptacles, light fixtures. cctv cameras and external ceiling fans. Doors and windows shall also be watertight, adequately sealed and closed prior pressure washing work begins. The company is not responsible for damages as a result of water infiltration from poor or improper installation, grouting issues, maintenance or repair of electrical-related items or doors/windows.
- Roof Cleaning
- The Gurney Guys Operator will perform a quick inspection from a ladder or elevated position and will be looking for simple issues on your roof (i.e. broken tiles, defective sealing, etc.). The operator will make the client aware of any detected visible issues of concern and discuss /recommend potential solutions. Some of these issues may be fixed or addressed by our team with prior arrangements. The client understands that the Gurney Guys is not a roofing company and the inspection provided is a courtesy. The client understands that a roofing professional should be contacted if there are any concerns about the reported issues.
- Gutter Cleaning
- In most cases, our operators w ill clean your gutter off the roof, using a harness if necessary and a leaf blower. Sometimes due to a steep roof or difficult access, they will do the cleaning off the ladder. The client understands that any specific cleaning method that differs from the methods mentioned above must be requested in advance. The client also understands that if any other method is requested, an additional charge may apply. The client understands that if a downpipe is blocked, the operator may use a “jetter hose” to clear it or flush it using a garden hose. However, it is important to emphasise that our operators are not plumbers and in case of a blocked downpipe that cannot be unblocked using our standard equipment, The Gurney Guys will not be held responsibile and will be under no obligation to solve this type of problem. The operators do also not rinse the gutters every time they do a cleaning. It is only carried out if needed or specifically requested by the client (additional charges may apply).
- Window Cleaning
- Windows are divided into four parts: glass, frame, track, and sill. The client understands that the window cleaning service is only for the glass, any other service must be agreed upon in advance and described in the quotation. Removal of any building materials (i.e. cement, paint, silicone, adhesive tape, etc.) on the windows is not included in our window cleaning service, except if agreed in advance and described in the quotation.
- Biocidal Treatment of Roofs & External Surfaces
- The client understands that the Biocidal Treatment organic growth of substances such as mould, moss lichen and algae on roofs and other surfaces are a gradual acting process that work in conjunction with the wind, sun and rain to clean the surface. The duration to see results will vary depending on the type of surface, the porosity, climate, level of growth and the amount of rainfall received over the period. Some surfaces may start showing noticeable results in a matter of 2 to 4 weeks and be clear in as little as 3 months, whilst other surfaces may take up to 12 months or longer to clean up. completely.
- Sealing of Concrete and other Surfaces
- The Gurney Guys will discuss the various types of sealers available, the recommended methods of application and the expected results according to the manufacturers specifications. Results, finishes, colour tones, textures and lifespan will consequently vary and the client understands and accepts the expected results and limitations in line with the agreed /selected sealer and method of application.
- Colour and Tone Concerns
- The properties and species of wood age and weather can greatly affect the resulting colour or tone of the stain. Note: Variances may occur on individual boards as well as the total project, as densities and other characteristics vary across and throughout the wood. The Gurney Guys and its associates attempt to represent the final finish colour and tones as best as possible.While we can often give you an idea of the overall colour or tone you must expect some variance in the overall finish
- Concrete
- The appearance of concrete depends on a number of factors most linked to when the concrete was initially poured and cured. When concrete with dirt, mould, mildew, algae and other substances, pollutants and stains is cleaned, the concrete will generally reveal any and all imperfections that the were covered up. The customer understands that not all concrete will look the same even on the same driveway, patio, sidewalk, or concrete slab.
- Stains
- Some stains cannot be removed by power washing. Tree sap, artillery fungus, splatters from stains and paints are examples of materials that cannot be removed by conventional means.We make every attempt to point these areas out to the customer when quoting the project. Sometimes these stains cannot be removed at all.
- Watertight
- The Gurney Guys Services expects your property to be in good repair and weathertight. This includes, but is not limited to all electrical services including receptacles and light fixtures. Doors and windows shall also be weathertight. The Gurney Guys Services is not responsible for damages as a result of water infiltration from poor or improper installation, maintenance, or repair of electrical-related items or doors or windows. The Gurney Guys cannot guarantee removal of artillery fungus from exterior house surfaces.
- Water Tanks
- Customer to ensure that Rain Water Tanks are Isolated so that run -off from roof & gutters cannot enter them during the cleaning process (it is recommended that following Roof Cleaning that it is kept isolated for at least 1 week and one decent rainfall before re-connecting and in the case of Biocidal Treatment that it is kept isolated for at least 3-4 weeks and two decent rainfalls before reconnecting. Run off water should also be tested for drinking suitability etc before reconnecting.
- Client Satisfaction
- If there is probable and clear cause that the service was not completed to satisfaction or there is clear evidence of poor workmanship, we will return to rectify any uncompleted or unsatisfactory portion of the work free of charge or otherwise agree with the client on a suitable discount or rebate in relation to the relevant portion of the work, if preferred. Any such claims must be reported within 48 hours of the completion of the service by phone, email or text message.
- Additions & Variations to Service
- Any changes to the Service requested by the Client must be formally agreed to by The Gurney Guys prior to the commencement of any work.
- If the Client requires any additional services or variations at the time the Service is being performed, the Client must first contact The Gurney Guys management by telephone unless management is on-site. If such work is authorised by The Gurney Guys management an additional charge may be invoiced to the Client for such works that was not part of the originally agreed scope of work as per the details on the quotation. At no stage should the client enter into any form of agreement directly with the Operator on site as no guarantee will be given and or liability accepted by The Gurney Guys for quality and /or damages incurred under such circumstances.
- Purchase Orders
- If purchase order numbers are required for work to be carried out and /or an invoice to be paid, it is the responsibility of the Client to provide it to The Gurney Guys at the time of accepting the quotation and /or making the booking.
- Invoicing & Payment Terms
- Full payment of any balance will be strictly due as Cash On Delivery upon completion, unless otherwise provided for in the quote or agreed to in writing prior to commencement of the work.
- An invoice will be sent to the person or company at the time of the completion of the Service.
